«GET EXPERTS RECRUITMENT» Foreign limited liability company (registered address: Republic of Uzbekistan, Tashkent city, Mirabad district, Turkestan street 12A, TIN 310007546), hereinafter referred to as the “Operator”, represented by General Director Krivosheev Danil, acting on the basis of the Charter, on the one part, and a natural person who fully and unconditionally accepts the terms and conditions of this accession agreement in accordance with Articles 367 and 369 of the Civil Code of the Republic of Uzbekistan and Law No. ЗРУ-547 dated July 02, 2019 “On Personal Data” and expressed his/her acceptance of this offer by:
- posting his/her personal data on the Operator’s websites (filling out questionnaires and forms);
- sending a response to a job vacancy on the Operator’s websites;
- putting a mark on his/her consent to the terms and conditions of the offer (“tick”) on the Operator’s websites;
- sending CV via the website or to the Operator’s e-mail,
thereby having confirmed his/her consent to the terms and conditions below, hereinafter referred to as the “Applicant”, on the other part, collectively referred to as the “Parties”, have entered into this Agreement as follows:
- THE SUBJECT MATTER OF THE AGREEMENT
- The Applicant provides his/her personal data in order to be assisted in finding employment or organizing another type of cooperation between the Applicant and a potential employer, informing the Applicant about emerging career opportunities, conducting a preliminary interview for the purpose of employment or another type of engagement, providing services/performing work by the Applicant on the basis of a civil law contract, as well as for the purpose of the Operator’s activities related to human resource management and labor market analytics. The Operator processes the personal data of the Applicant solely for the above purposes in accordance with the legislation of the Republic of Uzbekistan.
- CONDITIONS FOR PROCESSING THE PERSONAL DATA OF THE APPLICANT
- The Operator shall process the personal data of the Applicant solely for the purposes stated in clause 1.1. of this Agreement.
- The personal data sent for processing include:
- full name;
- date of birth (day, month, year);
- gender;
- nationality;
- address of residence (city);
- phone numbers and e-mail addresses or information about other methods of contact;
- information about education, including postgraduate vocational education (level of education, form of education, the educational institution, year of graduation from the educational institution, qualification and specialty according to the diploma);
- information about the academic degree and title, dates of awarding the academic title/degree;
- information about advanced training, completed courses, tests, exams and assessments;
- information about command of foreign languages, level of command, preferred language of communication;
- information about skills and professional experience, including PC experience (level of software proficiency, speed of typing);
- professional area;
- specialization;
- information about work activities and their deliverables, including a list of duties, information about employers (month and year of employment, month and year of termination, position, company), promotion, transfers to a new position/job, reasons for termination and work experience;
- work permit;
- claimed position;
- claimed salary and salary at the current (previous) job;
- desired type of employment and work schedule;
- willingness for business trips and relocation;
- important criteria when choosing a job;
- information about the results of the job interviews and decisions made;
- information about preferences, preoccupations, interests and hobbies;
- picture;
- cookies: user data (IP address, location; OS type and version; browser type and version; provider; original source from where the user went to the website; pages viewed; number of page visits; information about website pages switching; duration of the user session; entry points (third-party websites containing links to the Website); exit points (links on the Website following which the user visits other websites); the language of the OS and the browser.
- To achieve the goals stated in clause 1.1. of this Agreement, the personal data of the Applicant may be transferred to third parties – legal entities included in the Group of persons1 of the Operator and the Clients of the Operator and the Group of Persons of the Operator (hereinafter referred to as the Clients of the Operator)2.
- For the purpose of technical support of the information systems of the Operator, the processing of the Applicant’s personal data may be assigned to the following entities:
- Pismo LLC (196084 Saint-Petersburg, Malaya Mitrofanyevskaya st., 5/1, bld. 1, apt. 342);
- Art Mash LLC (121352 Moscow, Slavyansky Boulevard, 5 bld. 1 apt. 120);
- Individual Entrepreneur Rodin Viktor Andreyevich (107023 Moscow, Elektrozavodskaya st., 21, bld. 41, office 303)
- IBS DataFort LLC (127434, Moscow, Dmitrovskoye highway, 9B);
- ALLIANCE TECHNOLOGIES LLC (119633 Moscow, Borovskoe highway 18 bld. 3, floor 1, sector 1, room 5, office 22);
- ЧП «Best Internet Solution» (100011, Uzbekistan, Tashkent, Navoi St., building 9, 4th floor, room 1)
- The Operator shall not provide personal data to third parties without the consent of the Applicant, and require same from other persons who have gained access to personal data, unless otherwise provided for by the current legislation of the Republic of Uzbekistan.
- The Operator processes personal data by performing certain actions (operations), including collection, recording, systematization, accumulation, storage, clarification (updating, modifying), extraction, use, transfer (provision, access), blocking, deletion, and destruction.
- The personal data shall be processed during the effective term of this Agreement.
- THE RIGHTS AND OBLIGATIONS OF THE APPLICANT
- In accordance with the subject matter of this Agreement, the Applicant shall:
- Provide true, accurate and complete personal data.
- Clarify (update) the personal data provided to the Operator, as required.
- Not introduce him/herself with the wrong name or on behalf of someone else and not mislead the Operator regarding his/her identity in any other way.
- The Applicant may:
- Obtain information about the Operator, its location, availability of the personal data related to the Applicant with the Operator and the sources of personal data by sending a request to the general address of the Operator office@getexperts.uz.
- Obtain information about third parties that receive the personal data of the Applicant, processed by the Operator.
- Clarify his/her personal data, demand their blocking or destruction if such personal data are incomplete, outdated, unreliable, illegally obtained or not required for the stated purpose of processing, as well as take legal measures to protect his/her rights.
- In accordance with the subject matter of this Agreement, the Applicant shall:
- RIGHTS AND OBLIGATIONS OF THE OPERATOR
- In accordance with the subject matter of this Agreement, the Operator shall:
- Process the personal data of the Applicant solely for the set purpose and on the terms established by this Agreement and the current legislation of the Republic of Uzbekistan;
- Make changes to the personal data based on a reasoned written request of the Applicant;
- Suspend the processing of the personal data and destroy the personal data of the Applicant at his/her reasoned request;
- Protect the personal data provided by the Applicant from unauthorized use, distortion, destruction or alteration;
- Within thirty days of the date of receipt of the reasoned written request of the Applicant alter, clarify, block or destroy his/her personal data.
- The Operator may:
- Suspend processing personal data and destroy the data of the Applicant if there are serious grounds to believe that the data provided by the Applicant are incorrect.
- Use personal data solely in the interests of the Applicant in the process of the Operator’s activities that do not contradict the subject matter of this Agreement and the purposes declared.
- Give its recommendations to the Applicant on improving the presentation of his/her personal data posted in the form of a CV and make technical editing to the information about the Applicant processed by the Operator.
- In case of acceptance (by clicking the checkmark) of this offer and consent to receive marketing mailings, the Operator may send to the Applicant the following marketing materials:
- Information about the labor market (research, articles and other materials);
- Open vacancies;
- Information about the company’s services, special offers;
- Invitations to online or offline events.
- In accordance with the subject matter of this Agreement, the Operator shall:
- THE LIABILITY OF THE PARTIES
- Persons guilty of violating the rules governing the processing and protection of personal data shall bear civil and administrative liability in accordance with the current legislation of the Republic of Uzbekistan.
- THE EFFECTIVE TERM OF THE AGREEMENT
- This Agreement shall enter into force upon acceptance of its terms and conditions by the Applicant and be valid until the Operator or the Applicant terminates this Agreement in the manner described below, or until the Agreement is terminated by consent of the Parties.
- This Agreement may be terminated by consent of the Parties or by the will of either Party:
- The application for termination of the Agreement at the will of the Applicant should contain the full name of the Applicant, e-mail address and mobile phone.
- The Applicant can send (write down) the application for termination in writing (on paper) at any office of the Operator or send it to the office by Uzbekistan Post.
- The Applicant can send an electronic application for termination at office@getexperts.uz.
- In the event of termination of this Agreement, the Operator shall suspend processing and destroy the personal data within a maximum of thirty days from the date of receipt of the above application, except the cases provided for by applicable law, when the processing of personal data is allowed without the consent of the subject of personal data.
- FINAL PROVISIONS
- The Operator processes the personal data of the Applicant, corresponding to the purpose declared, free of charge.
- This Agreement is not an agreement between the Operator and the Applicant on the latter’s employment and it does not guarantee the Applicant’s employment.
- This Agreement may not be interpreted as providing for agency relations, partnership relations, relations on joint activities, personal employment relations, or any other relations between the Operator and the Applicant not expressly provided for in this Agreement.
- The Operator may amend the terms and conditions of this Agreement except clause 7.1. hereof unilaterally. If the Operator decides to amend the terms and conditions of this Agreement, it will post on its official Website a message about such an amendment and provide the Applicant with the opportunity to review the new terms and conditions at least one (1) calendar month before the effective date of such amendments.
- Should the Applicant not agree with the new terms and conditions of the Agreement, he/she shall send to the Operator a refusal to accept the new terms and conditions of the Agreement before the amendments come into force in accordance with clause 6.2 of this Agreement. The receipt by the Operator of a written refusal and the destruction of personal data shall mean the termination of this Agreement. The Operator’s failure to receive such a refusal within the period specified in clause 7.4 shall mean full and unconditional consent of the Applicant to the new terms and conditions of this Agreement.
- Relationships between the Parties not covered by this Agreement shall be governed by the provisions of the current legislation of the Republic of Uzbekistan.
- In the event of disputes, the Parties shall take all reasonable measures required to resolve same through negotiations. Should the Parties not reached an agreement during the negotiation process within ten (10) calendar days, such disputes shall be resolved through judicial procedures, established by the current legislation applicable at the location of the Operator.
